DUONS 1-year Limited Warranty for ServersCheck Hardware
DUONS' warranty obligations are limited to the terms set forth below: Duons MCO Pty Ltd ("DUONS") warrants this hardware product against defects in materials and workmanship for a period of ONE (1) YEAR from the date of original purchase. If a defect exists, at its discretion DUONS will (1) repair the product at no charge, using new or refurbished replacement parts, (2) exchange the product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original product, or (3) refund the purchase price of the product. A replacement product/part assumes the remaining warranty of the original product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes DUONS' property. When a refund is given, your product becomes DUONS' property.
OBTAINING WARRANTY SERVICE
Log in to your account to initiate the warranty process. Click on the "Resolution Centre" link and follow the steps. Once you have lodged your request DUONS will assess it and issue a Return Material Authorisation ("RMA") number if applicable.
All service returns must have a RMA # clearly displayed on the outside of the return package.
DUONS suggests that you return the package with a shipping carrier that has a reliable tracking system as DUONS is not responsible for lost or misdirected returns. Shipments have to be prepaid. Shipments that require shipping fees to be paid will be refused by DUONS and returned to the sender at their expense. Make sure to put $1 as commercial value, since the products are being returned for service. If the shipment requires custom forms to be completed then clearly indicate that this is a product return for service

EXCLUSIONS AND LIMITATIONS
This Limited Warranty applies only to ServersCheck hardware products manufactured by or for DUONS that can be identified by the "ServersCheck" trademark, trade name, or logo affixed to them. The Limited Warranty does not apply to any non-ServersCheck hardware products or any software, even if packaged, installed on or sold with ServersCheck hardware. Non-ServersCheck manufacturers, suppliers, or publishers may provide their own warranties. Software distributed by ServersCheck under the ServersCheck brand name is not covered under this Limited Warranty. Refer to the ServersCheck End-User License Agreement for more information. DUONS, ServersCheck and its Authorised Partners are not liable for any damage to or loss of any programs, data, or other information stored on any media, or any non-ServersCheck product or part not covered by this warranty. Recovery and reinstallation of system and application software and user data are not covered under this Limited Warranty. This warranty does not apply: (a) to damage caused by accident, abuse, misuse, misapplication, or non-ServersCheck products; (b) to damage caused by service (including upgrades and expansions) performed by anyone who is not a DUONS employee or DUONS contractor; (c) to a product or a part that has been modified without the written permission of DUONS; or (d) if any ServersCheck serial number has been removed or defaced; (e) to non-hardware failure damage or (f) if any other software has been installed on the hardware.
DUONS is not responsible for lost or misdirected returns. Shipments that require shipping fees to be paid will be refused by DUONS and returned to the send at their expense.
Following products are explicitly excluded from the warranty: cables and power adapters.
External causes such as accident, abuse, misuse, or problems with electrical power are not covered. Are also not covered by this warranty: Servicing not authorised by DUONS, or Usage that is not in accordance with product instructions, or Failure to follow the product instructions or failure to perform preventive maintenance, or Problems caused by using accessories, parts, or components not supplied by DUONS.
No Product may be returned directly to DUONS without first contacting DUONS for a Return Material Authorisation ("RMA") number. If it is determined that the sensor may be defective, you will be given an RMA number and you will have to follow our RMA procedure for Product return. An unauthorised return, i.e. one for which an RMA number has not been issued, will be returned to you at your expense. Work on units that have been returned under a RMA and for which the limited warranty does not apply, will be invoiced at $125 AUD per started hour.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AS COVERED BY AUSTRALIAN LEGISLATION. DUONS'S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS WARRANTY STATEMENT. ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN TIME TO THE 1 YEAR TERM OF THE LIMITED WARRANTY PERIOD. NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER THE LIMITED WARRANTY PERIOD HAS EXPIRED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU.
WE DO NOT ACCEPT LIABILITY BEYOND THE REMEDIES PROVIDED FOR IN THIS LIMITED HARDWARE WARRANTY OR FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LIABILITY FOR THIRD-PARTY CLAIMS AGAINST YOU FOR DAMAGES, FOR PRODUCTS NOT BEING AVAILABLE FOR USE, OR FOR LOST DATA OR LOST SOFTWARE. OUR LIABILITY WILL BE NO MORE THAN THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF A CLAIM. THIS IS THE MAXIMUM AMOUNT FOR WHICH WE ARE RESPONSIBLE.
DUONS IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH DUONS PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT. DUONS SPECIFICALLY DOES NOT REPRESENT THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA.
